TERMS AND CONDITIONS OF PAYMENT AND CANCELLATION - Oporto Shore Tours
1. INTRODUCTION AND APPLICABILITY
These Terms and Conditions regulate the contractual relations established between Oporto Shore Tours, headquartered at Rua do Corgo nº 698 1º Esq. Tras. 4455-104 Porto, hereinafter referred to as "OST," and the Client. By making a reservation, the Client accepts and agrees to these Terms, so it is advisable to read them carefully before proceeding with any reservation. These Terms establish the rights and obligations of the parties, including payment, cancellation, and liability conditions.
2. PAYMENT TERMS
Full Payment: The total amount of the reservation is due at the time of booking and is subject to the availability of the services offered and their confirmation by OST.
Accepted Payment Methods
OST accepts the following payment methods:

Credit card (Visa, MasterCard, and American Express), subject to the service fees in effect at the time of the transaction;

PayPal transfer, subject to the service fees in effect at the time of the transaction;

Bank transfer, with fees borne by the Client;
-
Cash (by prior agreement between the parties) up to a limit of €500 (five hundred euros).
3. Insurance Recommendation
OST recommends that the Client purchase appropriate travel and health insurance before booking any tour to ensure protection during the provision of services.
4. Cancellation Terms
Cancellation by the Client
The Client must inform OST as soon as possible if they need to cancel a reservation. The refund conditions are as follows:

Cancellation more than 30 days in advance: 90% refund of the amount paid.

Cancellation between 30 and 14 days in advance: 50% refund of the amount paid.

Cancellation less than 14 days in advance: no refund.
Cancellation Due to Unforeseen Circumstances
If the tour is canceled due to unforeseen circumstances, such as illness, injury prior to travel, wildfires, adverse weather conditions, or other situations considered as force majeure, OST will make reasonable efforts to reschedule the tour or provide an alternative solution. However, OST reserves the right to retain certain fees to cover services that have already been booked, such as winery reservations, lunches, tours, and other non-refundable costs..
Cancellation by OST
OST reserves the right to cancel a tour or service due to force majeure, adverse weather conditions, legal, governmental, or administrative orders, pandemics, wars, threats, or any other circumstances that may jeopardize the safety of participants. In such cases, if the reason is not due to intentional misconduct or gross negligence by the Client, they may request a full refund or reschedule the tour for another date, as determined by OST in each specific case.
5. Acceptance of Risk and disclaimer of liability
Assumption of Risk
The Client acknowledges that certain tours offered by OST may involve inherent risks due to the type of experience, the location where it takes place, or the time period in which it is scheduled, especially in cases of adventure and exploration experiences. The Client fully accepts that they are responsible for any risks associated with participating in the tours.
Liability Waiver
By participating in a tour, the Client releases OST, as well as its employees, guides, agents, or partners, from any liability for personal injury, moral damages, accidents causing injury or even death, as well as material losses resulting from participation in the organized activities.
Liability Form
OST may require the Client to sign a liability waiver before the start of certain tours, confirming their acceptance of the risks involved. Refusal to sign the waiver will result in the Client being unable to participate in the tour, and they will forfeit the cost of the tour.
6. Recommendations During Tours
OST advises the Client to exercise caution when purchasing goods during the tours. OST is not responsible for the quality, authenticity, safety, integrity, or origin of products purchased by the Client during any tour.
7. DISPUTE RESOLUTION
In the event of a dispute, the Client may contact the Consumer Information and Arbitration Center of Porto, an independent and certified entity for alternative dispute resolution. For more information, the Client can visit the website www.cicap.pt.
8. PRIVACY POLICY
Collection and processing of personal data

Oporto Shore Tours is committed to protecting the privacy of its Clients' personal data in compliance with the General Data Protection Regulation (GDPR). OST collects, processes, and uses personal data lawfully, transparently, and fairly, respecting the rights of the data subjects, including the right to rectification and the right to be forgotten.

During the booking and service provision process, OST may collect the following personal data:

Payment details (credit card details are processed for payment guarantees but not stored by OST);

OST implements appropriate technical and organizational measures to ensure the security of personal data, protecting them against unauthorized access, loss, destruction, or alteration.

Personal data will be retained for the period necessary to fulfill the purposes for which they were collected or to comply with legal obligations.

Client Rights
Under the GDPR, the Client has the following rights:
